The year 2019 is marked to be a landmark moment for BONAVERI with the final and positive results of a four years legal battle over copyright infringements against fashion company ELLASSAY.
The issue was about the infringement of the copyright of Bonaveri mannequin collection named Aloof, under the worldwide famous Schläppi brand. Chinese fashion company Ellassay, listed on the stock exchange, had copied and displayed in their shops a perfect reproduction of Aloof, claiming the IP rights. They declared to have been the first to develop it with their own sculptor.
Once aware of the situation, Bonaveri took actions to file a court suit against Ellassay and, on the judgment of the Court of first instance and of the appeal, the Judge confirmed the absence of the creative process of Ellassay.
Ellassay was punished with to payment of economic damages while Bonaveri has had the acknowledge of the full IP rights.
The sentence is remarkable and important because it recognises and states the creative process of Bonaveri, the investments in terms of research and development and order an important Chinese fashion company, listed in the stock exchange, to pay damages.
We do believe that this sentence will definitely be a significant precedent for other similar cases.
It is also worth noting that China is adopting a wider and stricter legal protection and raising awareness of the judiciary towards the problem of IP infringement.
For Bonaveri, this has a meaning of great success in terms of recognisability and ownership of the IP rights on our mannequins that more and more are becoming a point of reference in China and need a higher protection.
